Scope

This is MGS Mfg. Group, Inc.’s (“MGS,” “us,” “we,” “our”) privacy policy (this “Policy”) and it applies our website mgsmfg.com and related subdomains, any other website operated by MGS that links to this Policy (together, “Websites”) and our data collection practices when you provide us with your personal information, access or use certain online services offered by MGS, including where this Policy is incorporated by reference (our “Online Services”). Specifically, this policy describes the personal information, we may collect from you, about you, or that you may provide to us when you interact with us through our Online Services or with MGS in-person or through other offline channels (i.e., “offline”) (collectively, the “MGS Services”) and how we use, protect, and disclose such information.

By accessing or using the MGS Services and/or submitting information to MGS, and or acknowledging your agreement to MGS’ Website Terms of Use you agree to this Policy. This Policy may change from time to time. We will post the updated policy at this address (or an address we later designate) and update the effective date on this document. Your continued use of MGS Services after we make changes to this Policy is deemed to be your acceptance of any such changes, so please review this page periodically for updates.

Personal Information Collection: What we collect

The chart below lists the categories of personal information that we may collect from or about you through the MGS Services:

Categories of personal information we collect and how we collect it

Identifiers. This may include a real name, alias, address, email address, phone number, online identifier, IP address, account username and password, job title, or other similar identifiers.
Internet and network information. This may include IP address, browser type and version, information about your interaction with our Websites, application, service or advertisement, such as browsing history and information about how you use your account.
Commercial information. This may include information regarding services purchased, order information and information relating to your use of the MGS Services.

We may also collect, use and disclose non-personal information. We may use or disclose information that we have collected that has been de-identified or anonymized so that it does not personally identify you.

How we collect information

We collect information from or about you through the following methods:

  • When you provide information to us voluntarily, through the Online Services, including by filling out forms, registering for an account, purchasing our products or services, signing up for marketing communications, requesting information about our products or services, or any other data entry method in the Online Services;

Legal Basis
In some jurisdictions, we are required to identify our legal grounds for processing your personal information. Not providing your personal information may result in disadvantages for you. For example, you may not be able to receive our Online Services, purchase or use our products, or receive marketing information. However, unless otherwise specified, not providing your personal information will not result in legal consequences for you. Who we disclose your information to

Further, we may disclose your information when we are required to do so by law, including as the result of a court order, legal process, subpoena, or other lawful request, or where we otherwise have a legal obligation to do so;
  • With a buyer, successor in interest, or any other party involved in a merger, acquisition or other sale or transfer of all or some of MGS’ assets, equity or business or any similar transaction, or as part of a bankruptcy, liquidation, dissolution or similar proceeding, as well as advisors, lawyers, accountants and other third parties that may assist in the negotiation, review, and consummation of any such transaction or proceeding;

Cookies and related tracking technologies

Like most companies, we (and our service providers and certain third parties) collect information about you automatically, including when you interact with MGS Services. We collect this information through a variety of technologies, for example, we use:

  • Google Analytics: We use Google Analytics to gather statistics from our Websites and Online Services. If you choose, you can opt out by turning off cookies in the preferences settings in your browser or download and install Google Analytics Opt-out Browser Add-on at http://tools.google.com/dlpage/gaoptout.   • LinkedIn & Facebook: MGS’ Websites and Online Services also include functionality, cookies and other automated data collection from Facebook and LinkedIn. The cookies and other data collection by LinkedIn and Facebook allow us to place ads on certain social media websites, measure your engagement with those ads, tailor ads to you, measure your ad conversion, and provide us information about your interactions with us on social media.
    • With respect to LinkedIn, we use the LinkedIn Insights Tag to retarget our website visitors and learn insights about your interactions with our LinkedIn advertisements. You can learn about LinkedIn’s privacy practices at www.linkedin.com/legal/privacy-policy, and you can opt out of LinkedIn Insights Tag at www.linkedin.com/psettings/.
    • With respect to Facebook, we use Facebook Pixel to measure the effectiveness of our advertising by understanding the actions you may take on our website. Facebook Pixel assists us in customizing our advertising and serving you ads on your social media based on your browsing behavior. You can learn about Facebook’s privacy practices at www.facebook.com/about/privacy/, and you can opt out of the collection of your data by Facebook Pixel or the use of your data for the purpose of displaying Facebook ads by visiting www.facebook.com/settings?tab=ads (you will need to log into your Facebook account).
  • Twitter: We also use a cookie from Twitter that allow certain social media functionality from Twitter on our webpage. To learn more, please visit: https://help.twitter.com/en/rules-and-policies/twitter-cookies.

It is important to understand what these technologies are:

  • Cookies: A cookie is a small text file that is sent to your browser when you access a website. There are two types of cookies, session cookies and persistent cookies. A session cookie is available and exists only during the course of the browser session. Closing the browser or logging off will invalidate the session cookie. Persistent cookies, similar to their name, last for a longer period of time, from hours, days, or weeks, and remain on your hard drive (or other storage medium) and record or disclose information about you and your interactions with websites and services.   • Embedded Scripts: These are also bits of code on a website or service that measure how a user interacts with a website, application, or service; the scripts are often in JavaScript, a common programming language.

Please note that when you opt-out at the websites above, and in general, the opt-out is effective only for the device that you use to opt-out. It will not prevent data collection or targeted ads for other devices that you use – you will need to opt-out on each device. Additionally, certain opt-outs require that a cookie be placed on your device to record your preference. Selling, sharing, and targeted advertising

Certain privacy laws, including those in California, require that we disclose whether we sell or share your personal information for targeted advertising to any third parties. When you interact with our Online Services, we may use, or authorize third-party partners and service providers to use, cookies, web beacons and similar technologies to improve your experience with us. In addition, some browsers offer you the ability to opt-out of the sharing of your personal information by turning on a Global Privacy Control. You can turn on a Global Privacy Control in your web browser or browser extension or by visiting https://globalprivacycontrol.org/. At this time, we endeavor to respond to browser-based opt-out signals sent through the Global Privacy Control.

Your rights and choices

  • Rights: Depending on your location and applicable law, you may have certain rights regarding your personal information. These rights may include:
    • Right to Know: The right to request any or all of the following information relating to your personal information we have collected and disclosed, upon our verification of your identity:
      • The categories of personal information we have collected about you.
      • Our business purpose for collecting that personal information.
      • The categories of third parties with whom we disclose that personal information.
      • The specific pieces of personal information we have collected about you.
      • The categories of sources of the personal information we have about you.
    • Right to Request Deletion: The right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions.
    • Right of Portability: The right to request a copy of your information in an accessible format.
    • The Right to Correct: The right to correct inaccurate personal information that we maintain about you.
    • The Right to Withdraw Consent or Limit Processing: Where processing of personal information is based on consent, you have the right to withdraw your consent at any time. Where processing of personal information is based on legitimate consent, you also have the right to request we limit or restrict how we use your information.
    • The Right to Opt-Out of the Targeted Advertising and the Sale or Sharing of Your Personal Information in Certain Circumstances: The right to direct us not to sell or share personal information we have collected about you to third parties for targeted advertising.
    • The Right to Non-Discrimination: The right not to receive discriminatory treatment for exercising these rights.
    • “Shine the Light”: California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information to a third party for the third party’s direct marketing purposes.
    • The Right to Appeal: The right to appeal our decision regarding your request within a reasonable time period dependent on applicable law.
    • The Right to Object:
      • Object to any processing of personal information that we process on the “legitimate interests” or “public interests” grounds, unless our reasons for the underlying processing outweighs your interests, rights, and freedoms; and/or
      • Object to direct marketing (including any profiling for such purposes).
    • The Right to Make a Complaint: The right to make a complaint to your local government or supervisory authority if you feel your rights have been violated.
  • Exercising your rights: To exercise your rights described above, please submit a verifiable consumer request to us through one of the contact methods described in the “How to contact us” section below. If you make a request as described above, we will verify your identity before honoring any such request, which may involve asking you to provide or confirm certain information about yourself. For example, we may request up to three pieces of personal information about you, and we reserve the right to take additional steps as necessary to verify your identity if we have reason to believe a request is fraudulent. We engage in verification where required by law, or where we believe it is necessary to protect your privacy and prevent fraud or impersonation. Only you, or a person that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. If you are making a request on behalf of another person, you must provide written legal documentation that you are authorized to act on behalf of that individual. The verifiable consumer request must:
    • Provide sufficient information that allows us to reasonably verify you are the person about whom it collected personal information or an authorized representative; and
    • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
    • In certain circumstances, you may also be able to make a request through your agent; any such request may also involve a verification process. Please note, we may not be able to fulfill your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. If you do not agree with how we responded to your request, you may ask us to review our decision by contacting us through the above noted methods. Response format: MGS endeavors to respond to a verifiable consumer request within 30 to 45 days of its receipt depending on where you are located. If MGS requires more time, it will inform you of the reason and extension period in writing. MGS will deliver the written response by mail or electronically, at your option. The response MGS provides will also explain the reasons it cannot comply with a request, if applicable. For data portability requests, MGS will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
  • Additional Choices:
    • Cookies and Related Tracking Technologies: If you do not wish us to place cookies or utilize other related tracking technologies, you may set your browser to refuse such technologies that are not essential for the functionality of our Websites, or to alert you when such technologies are being sent.     • Marketing Opt-out: If you do not wish to receive further non-transactional, marketing emails from us, you may opt-out by clicking the “unsubscribe” link in any such emails or contacting us using the methods described below.

Important information

  • The Services are offered and available to users who are 15 years of age or older. The Services are not directed to children under 15. In the event that we learn that we have collected personal information from a child under the age of 16 without parental consent, we will delete that information. If you learn that your minor child has provided us with personal data without your consent, contact us.
  • This Privacy Policy does not apply to any data collection that occurs on any services or websites that are not MGS Services, including websites that you may reach by clicking on a link through the MGS Services. We encourage you to read the privacy policy of all websites that you visit.
  • The privacy, safety and security of your information also depends on you. You are responsible for keeping your information confidential and secure, and we encourage you to always use good cybersecurity and privacy hygiene.
  • To help protect the privacy of data we collect through the MGS Services, we employ measures designed to protect your personal information. Unfortunately, the transmission of information via the internet is not completely secure. We urge you to take every precaution to protect your personal information when you are on the internet. Although we do our best to protect your personal information, we cannot guarantee the security of personal information transmitted to or through the MGS Services. Any transmission of personal information is at your own risk.
  • Data will be retained in compliance with our internal data retention procedures.
  • MGS is based in the United States and all information we collect will be stored in the United States (or in certain circumstances, where required by our customers). To provide the MGS Services, we or our service providers may process personal information in the United States, or in other locales across the globe. If you are not a resident of the U.S., you hereby consent and agree that we (and our service providers) may collect, process, use, transfer, and store your information, as discussed in this policy, outside your resident jurisdiction. Please be aware that United States law and the laws of other countries where we may store and process your information may offer different levels of protection for information than may be available in your country, and some of these locales may have been deemed to offer inadequate protection under certain laws.
